The Xplorion respects the intellectual property rights of others and expects users and contributors to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), 17 U.S.C. § 512(c)(3), and equivalent provisions in international copyright law including the EU Copyright Directive, we respond to clear, valid takedown notices.
How to file a takedown notice
Email [email protected] with all of the following:
- Physical or electronic signature of the copyright owner (or authorised agent)
- Identification of the copyrighted work claimed to have been infringed
- URL(s) where the material appears on our site, with enough detail that we can locate it
- Your contact information — full legal name, mailing address, phone and email
- A good-faith belief statement that use is not authorised
- A statement under penalty of perjury that the information is accurate and you are the owner or authorised agent
- Any supporting evidence (registration number, publication date, original source)
What happens next
Our DMCA agent acknowledges receipt within 72 hours and reviews for completeness and validity. If valid, we remove or disable the material typically within 24 hours. We notify the uploader; they may file a counter-notice. We terminate repeat infringers per our policy.
Counter-notice
If your content was removed in error, send a counter-notice to [email protected] with:
- Your physical or electronic signature
- Identification of the material and its location before removal (URL)
- A statement under penalty of perjury that removal was by mistake or misidentification
- Your name, address, phone, and consent to the jurisdiction of the federal court in Delaware (or outside the US, your district)
- A statement that you will accept service of process from the original notice-filer
Valid counter-notices are forwarded to the original complainant. We may restore the content after 10 business days unless the complainant files a court action and provides notice.
Misrepresentations
Under 17 U.S.C. § 512(f), knowingly making material misrepresentations in a takedown notice or counter-notice may lead to liability for damages, including costs and attorneys’ fees. Consult an attorney before filing. We may seek recovery of our costs against abusive notices.
Repeat infringer policy
In accordance with 17 U.S.C. § 512(i), we terminate accounts of users determined to be repeat infringers. A “repeat infringer” is any user whose account receives three or more valid DMCA notices within any 12-month period. Reviewed case-by-case by our General Counsel.
EU users: Article 17 of the Copyright Directive
EU rights holders may also notify us under Article 17 of Directive (EU) 2019/790. Same procedure as above; mark the notice “Article 17 Notice”.
