These Terms & Conditions govern your access to and use of thexplorion.com, our services, our newsletter, our shop and any related offering operated by Krafty Sprouts Media, LLC. By using the site you agree to be bound by these Terms. If you do not agree, do not use the site.
1. Who you are agreeing with
“We”, “us” and “The Xplorion” mean Krafty Sprouts Media, LLC, a Delaware limited liability company with its registered office at 19 West 34th Street, New York, NY 10001. “You” means the natural person or legal entity using the site.
2. Eligibility
You must be at least 16 years old (or the age of digital consent in your jurisdiction, whichever is higher). By using the site you confirm legal capacity. You may not: republish articles in full on another site; reproduce our logos/trademarks; train AI models on our content without a written licence (contact [email protected]); scrape at rates that affect site stability.
5. User-generated content
If you post User Content, you grant us a worldwide, royalty-free, non-exclusive, perpetual licence to display, distribute, modify, create derivative works and translate it on the site and in our marketing. You remain the owner. We do not pre-review but may remove at discretion.
6. Prohibited behaviour
- Automated scraping affecting site stability
- Reverse engineering, framing, or misrepresenting the site
- Posting unlawful, defamatory, harassing, or deceptive content
- Uploading viruses or disruptive code
- Unauthorised security probing
- Impersonating any person or entity, including our staff
- Buying/selling reviews or coordinated promotion
- Infringing any IP right
7. Purchases
Prices are in US dollars unless stated otherwise and include local taxes where applicable. Payments via Stripe or PayPal. Service delivery begins after payment clears and brief is confirmed. Delivery times are estimates.
8. Refunds and cancellations
Digital goods: no refunds once downloaded, unless defective or materially different from description.
Services: 30-day money-back guarantee if we fail to deliver per the agreed specification. Partial refunds for partially completed work.
Subscriptions: cancel anytime via account page or [email protected]; access continues to end of billing period; no partial refunds.
EU and UK consumers: you have a statutory 14-day cooling-off period under the Consumer Rights Directive, except for digital content already consumed.
9. Affiliate and sponsored content
Some articles contain affiliate links through which we may earn commission at no cost to you. Sponsored content is labelled “Sponsored” prominently and does not reflect editorial opinion. We comply with FTC, ASA UK, and equivalent rules.

12. Limitation of liability
To the maximum extent permitted by applicable law, The Xplorion and its parent company are not liable for any indirect, incidental, consequential, special or exemplary damages. Our total aggregate liability for any single claim, and for all claims in any twelve-month period, is capped at the greater of US$100 or amounts you paid us in the preceding six months. Nothing excludes liability for death, personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.
13. Indemnity
You agree to indemnify The Xplorion against any claim arising from your breach of these Terms, your User Content, or your use of the site in violation of law.
14. Changes to these Terms
Material changes are announced on-site or by email at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.
15. Governing law and disputes
Delaware law governs these Terms, without regard to conflict rules. Disputes resolved in New Castle County, Delaware. EU, UK and Brazil consumers retain the right to use local court and local consumer-protection law.
16. Arbitration (US users)
US disputes resolved by binding individual arbitration under the Commercial Arbitration Rules of the American Arbitration Association. You waive the right to a jury trial and to participate in a class action. Opt out within 30 days by emailing [email protected].
17. Severability
If any provision is held unenforceable, the remaining provisions remain in full force; the unenforceable provision is modified to the minimum extent necessary.
18. Entire agreement
These Terms together with our Privacy Policy, Cookie Policy, Disclaimer and DMCA Policy constitute the entire agreement.
